2015年，邹某与朋友合股在山东单县开了一家儿童摄影店，经营期间就曾推出微信集赞，免费摄影活动来宣传招揽生意。尽管后来因股东间闹矛盾，邹某退出该店，但此次的集赞活动，却让负债的邹某滋生诈骗恶念。

“这种方式来钱比较快，可以去别的地方弄些钱用”邹某说道。

离开原影楼不久后，邹某很快在网上找到安徽明光市有一家某宝贝摄影店要转让，并于2015年11月底从原店主手中转让这家摄影店。

2015年12月初，邹某便将自己预谋的诈骗伎俩付诸于行动。在微信中集赞、转发活动内容，就可免费拍摄398元或498元的照片套餐，另外还送一份碗具，但拍照前要先交200元押金，待拍完照片取照片时便退还给顾客。活动开始的短短几天时间里，就有近百位顾客前来店里交钱。12月中旬，邹某带着骗取的2万余元离开安徽。

骗取的钱根本就不足以还债和日常开销，只得另寻地方。

2016年1月，邹某在论坛上看到苍南龙港一家摄影楼在转让，便向朋友借了钱签下该家摄影楼。“以集满38个赞，即可免费参与拍摄398元或498元的照片套餐，并领取一台榨汁机，但需先交300元押金”的宣传内容吸引大量的顾客，一周时间内，邹某便骗取近400名被害人保证金12万余元，携款逃跑，人去楼空。

法院审理认为，被告人邹某无视国法，以非法占有为目的，采用虚构事实、隐瞒真相的方式骗取他人财物，数额巨大，其行为已构成诈骗罪。因该案诈骗涉及人员众多，社会影响恶劣，可酌情从重处罚；但被告人邹某主动投案并如实供述犯罪事实，具有自首情节，可从轻处罚。法院遂依法作出上述判决。
