全国首例伪基站民事诉讼案件：山东移动胜

记者获悉，山东移动对伪基站违法行为主动提出民事诉讼并取得重大进展。日前，经过审理，临沂市兰山区人民法院对使用伪基站设备发送垃圾短信的两名被告人作出一审判决：

依照《中华人民共和国民法通则》第106条第二款、第134条规定，判决两名被告人支付临沂移动公司赔偿款85000元。该案件为全国首例伪基站民事诉讼案件，对利用伪基站的犯罪分子起到法律和经济的双重震慑，同时也为运营商通过法律途径合法维权提供了较好的经验和思路。

2013年11月25日14时，移动公司后台监控发现疑似伪基站使用区域，经过工作人员现场测试确认，临沂市兰山区半程镇金锣集团附近有两名嫌疑人利用无线基站设备发送垃圾信息，移动公司工作人员立即拨打110向公安机关报警。兰山公安分局半程派出所出警，根据二人的违法事实、违法情节、危害程度、社会危害性，依据《中华人民共和国治安管理处罚法》相关规定，半程派出所报经兰山公安分局批准，对二人作出治安拘留决定并没收违法设备。

收集确凿证据后，临沂移动公司提出了民事索赔诉讼，法院主要就被告作案过程、作案工具、当事人主观故意以及造成的影响进行了调查，并于2014年3月28日作出判决，临沂移动公司胜诉。判决认定两被告未经许可利用无线设备，非法占用原告的频率资源发送垃圾信息，扰乱原告的正常经营秩序，造成了原告一定的经济损失，依法应当赔偿原告。

记者了解到，2014年以来，山东移动发现伪基站活动线索128次，配合公安机关等部门破获伪基站案件57件，扣押伪基站设备57套，抓获不法分子81人，打掉了一个经营范围遍布全国的贩卖伪基站设备团伙。
