而今年6月，T-Mobile方面表示愿意和华为签署专利授权以及非披露协议，但T-Mobile始终拒绝和华为进行面对面的谈判。华为本次向T-Mobile提出控诉，目的之一是希望法院认可华为在谈判中遵守了公平、合理、无歧视（FRAND）的原则。而在专利授权方面，华为也似乎也不情愿和T-Mobile签署相关协议了。
