据此,上海各级食品药品监管部门将对网络餐饮服务经营者、第三方平台实施食品安全信用管理,建立食品安全信用档案,记录对日常监督检查结果、违法行为查处、责任约谈及整改等情况,并根据信用记录,调整监督检查频次。同时,第三方平台存在违法行为并造成严重后果,依法应吊销许可证的,上海市食品药品监督管理局将函告上海市通信管理局,由上海市通信管理局依法吊销许可证;行为涉嫌犯罪的,按照相关规定及时移送司法机关。

有冷藏等特殊温度要求的食品(如冷菜、生食、冷加工糕点、预拌色拉),其配送条件应当符合保证食品安全所需的温度要求,不得将食品与有毒、有害物品一同配送。

《办法》鼓励在食品容器或者外包装上标示食品制作烹饪时间和安全食用时限,并提醒消费者收到后尽快食用。

第三方平台应实名登记

对于第三方平台,《办法》要求应当对网络餐饮服务经营者进行实名登记,记录其社会信用代码、食品经营许可证件编号、许可证有效期、核准名称、地址、经营项目、联系人、联系方式等信息。第三方平台还要通过与平台内的网络餐饮服务提供者签订入网协议等方式,明确双方应当遵守的食品安全管理责任、权利和义务。
