杨先生2002年住在公安新村，当时办理了中国铁通的电话及网络捆绑协议。2007年，他把这项业务迁至了泗水桥的住处。如今，他准备搬回原住处，就来到中国铁通蚌埠胜利路营业厅办理回迁手续，可经过查询，公安新村电话号码资源已经全部占用，对于他的迁移，铁通只能协调改为中国移动的网络，且没有电话号码提供。

杨先生表示家庭电话号码已经用了11年，如果不能使用，他只能退网。营业厅人员却称：退网可以，需要退还当初办理续网业务时，公司提供的三桶1.8升的色拉油和200元的固话话费优惠。

对于这个要求，杨先生表示很难接受，他认为是通讯公司自身原因造成无法提供电话和网络合并服务，这样对待消费者，有“霸王条款”之嫌。

对此，中国铁通蚌埠分公司胜利路营业厅马经理表示，对长期用户进行一定的物品赠送或话费优惠，这是公司的营销手段，但这些优惠是针对长期客户的，如果客户退网，优惠自然取消。

马经理说，作为营业厅人员，她没有权限对此进行相应的更改，她会向上级反映，会在24小时内给杨先生答复。

蚌埠市消费者协会何德启秘书长表示，消费者与通讯公司是一种合同行为，只有提供了完整的服务，才能视为完整履行。杨先生因为地址变动进行正常的业务变更无可厚非，铁通公司不能完整提供电话和网络的并加服务，存在瑕疵。消费者违约的责任不明显，因此铁通公司要求全部收回赠品不尽合理。
