河南法制报三门峡讯 近日，由（河南省）卢氏县检察院提起公诉的秦某涉嫌非法采伐国家重点保护植物罪案一审作出判决，卢氏县人民法院以秦某犯非法采伐国家重点保护植物罪判处其有期徒刑3年，缓刑3年，并处罚金3000元。无意间采挖3株“野草”就构成犯罪，这让秦某的思想受到了极大震动，也使周边的群众受到了深刻的法治教育。
秦某发现其农田附近的山坡上长着类似兰草的“野草”，便在干完农活回家时顺手采了3株，被森林民警查获。经河南林业司法鉴定中心鉴定，秦某非法采伐的兰草系兰属中的蕙兰，属于国家重点保护植物。当时，秦某被公安机关行政拘留7日。
2016年8月29日，卢氏县检察院检察官在查看两法衔接信息平台上的这一行政处罚信息时，认为秦某已涉嫌非法采伐国家重点保护植物罪，卢氏县森林公安局应作为刑事案件立案侦查，遂发出《要求说明不立案理由通知书》。卢氏县森林公安局接到该通知书后，依法对秦某立案侦查，并顺利移送起诉。
据卢氏县检察院侦查监督处处长杨妙伟介绍，中国从立法上加大环境资源整治力度，比较刚性的法律规定有污染环境罪，非法处置进口固体废物罪、擅自进口固体废物罪，非法捕捞水产品罪，非法猎捕、杀害珍贵、濒危野生动物罪，非法收购、运输、出售珍贵、濒危野生动物、珍贵、濒危野生动物制品罪等10多个罪名。公民如果法律意识淡薄，一不小心就可能构成犯罪。
