8月12日消息，因认为“应用汇”平台擅自提供音乐舞蹈手机游戏“天天炫舞”的下载、安装及在线运营服务，腾讯科技（深圳）有限公司等以侵害商标权纠纷为由起诉，请求判令被告北京掌汇天下科技有限公司停止侵害、赔偿损失、消除影响。目前，海淀法院受理了此案。

原告诉称，原告一依法享有“天天炫舞”商标专用权，且已授权原告二排他使用上述注册商标；两原告一直通过腾讯网及其他众多第三方平台在线运营“天天炫舞”音乐舞蹈手机游戏。被告北京掌汇天下科技有限公司为“应用汇”平台的运营单位，未经其允许向公众提供音乐舞蹈手机游戏“天天炫舞”的下载、安装及在线运营服务；对此，两原告曾多次向被告发函，要求其停止侵犯两原告“天天炫舞”注册商标专用权，但被告一直未予处理。

原告认为，被告在其“应用汇”平台上推广、运营“天天炫舞”游戏获利巨大，且在收到两原告的侵权通知后，仍不停止侵权行为，严重侵犯了其商标专用权。故诉至法院，请求法院判令被告立即停止侵犯两原告“天天炫舞”等注册商标专用权行为；被告连续一个月在“应用汇”平台首页显著位置就其侵害商标权行为刊登声明，消除影响；被告赔偿两原告经济损失及合理支出共计人民币50万元。

目前，本案正在进一步审理中。
