7月7日消息，日前，腾讯前总监岳雨被控任职腾讯期间侵占公司财产以及受贿一案获得一审宣判，岳雨被判职务侵占罪与非国家工作人员受贿罪成立，数罪并罚，执行有期徒刑9年。

据国内媒体报道，法院审理查明，担任腾讯公司网络拓展部以及在线视频部总监的岳雨与下属樊丹、张东波等人，代表腾讯公司与多家电视台开展合作以及广告投放业务时，均是通过岳雨指定一家第三方公司签署合同。这些合同均被虚增了广告投放费用，有高达数百万资金通过这家第三方公司套取，最终流入岳雨以及樊丹、张东波的口袋中。

法院审理认定，岳雨从中侵占腾讯公司资金373.9万元，张东波侵占68.4万元，樊丹侵占67.1万元。

岳雨除被认定职务侵占罪外，还被法院认定在2012年和2013年期间，利用腾讯公司采购耀客公司电视剧的机会索要回扣，回扣金额70万元，并确定回扣需要由现金支付。

该案庭审过程中岳雨曾辩称，通过第三方公司套取腾讯的资金，并非用做个人挥霍，而是公司允许的灰色公关费提取，用来降低公司的经营成本。但法院未予认可。

法院一审判处岳雨犯职务侵占罪，判有期徒刑七年，犯非国家工作人员受贿罪，判有期徒刑三年六个月，数罪并罚，执行有期徒刑九年。张东波犯职务侵占罪，判有期徒刑三年六个月。樊丹犯职务侵占罪，判有期徒刑二年。为岳雨等人走账套取款项的公司实际控制人肖峰被认定为该起职务侵占案的共犯，职务侵占罪名成立，判有期徒刑二年。
