华为“大导演”APP

据起诉书称，2001年7月，睿智高远公司核准注册了“大导演”商标，核定使用商品包括第9类“已录制的计算机程序（程序）、计算机软件（已录制）、计算机、计算机周边设备”，商标有效期至2022年6月。公司投入大量精力及成本，自主研发了“大导演”系列软、硬件产品，主要功能为图像、视频的编辑、剪辑等，并长期持有使用“大导演”商标。通过长年参加知名展会、组织活动、广告宣传以及众多渠道在中国范围内广泛销售，“大导演”系列的软、硬件产品已经在图像视频领域内建立起相当的知名度，并获得国家相关认证证书。

然而，睿智高远公司发现华为终端公司开发的一款软件产品，名称标识与“大导演”商标完全相同。同时，该公司还利用“华为市场”等手机应用平台、搜索引擎等诸多渠道，宣传推广其开发的“大导演”软件，下载数量至少已达几十万次。而华为技术公司则将“大导演”软件产品安装在其生产的P8手机上，并在2015年华为P8手机全国新品发布会上，通过新闻发布会、网站公开介绍等方式，对该软件进行大量宣传。同时，奇鸟软件公司在其经营的“thinksaas”手机应用网站上，提供华为终端公司“大导演”软件的下载服务。
