IT资讯讯 3月29日消息 互联网的大潮使得网络文学市场面临爆发的风口期，几部网络文学改编的影视作品已经形成强大的IP效应。然而和火爆的表象形成反差的是，由于缺乏良好的监管，网络文学也日益成为盗版的重灾区。近日，又一桩网络文学侵权案件引起了人们广泛注意。

具体来说，该案为上海玄霆娱乐（阅文集团旗下起点中文网）起诉神马搜索及UC浏览器侵权一案。阅文集团认为，神马搜索为UC浏览器联合他人研发的产品，而UC浏览器内置“小说频道”的内容又是由神马搜索提供。这种联合组成盗版侵权链条的行为，正在成为一种新型的侵权形式，不但阻碍了行业发展，也成为行业最大的毒瘤。

日前上海浦东新区人民法院对此做出一审判决：

一，判决认定UC浏览器内搭载的神马搜索提供转码阅读是侵权行为；

二，由被告神马搜索立即停止对原告阅文集团文学作品13部小说的网络传播权，判决被告神马搜索赔偿原告侵权损失及其合理支出共计54万元。

判决书表示：被告神马搜索未经许可，将原告阅文集团旗下起点中文网拥有版权的《完美世界》等13部小说作品放置在其服务器上，通过信息网络向用户提供阅读内容，构成对原告信息网络传播权的侵害。

分析认为，网络文学侵权案件时有发生，屡禁不绝，主要原因在于网络文学侵权利益链复杂隐晦，取证困难，缺乏有效的监管机制。目前，只有加大司法机关查处网络侵权盗版的力度，加大对侵犯知识产权行为的惩罚力度、从平台、销售、维权等环节做好监管，才能有效改善网络文学市场的盗版风气。
