据外媒29日报道，美国纽约南区法庭法官命令微软公司交出储存在该公司爱尔兰服务器内的资料。

据报道，这个针对一名微软电邮帐户使用者所发出的传票涵盖范围包括姓名、信用卡细节还有所有往来电子邮件等个人资料。

微软先前曾向客户再次保证，该公司位于海外的服务器，并不受到美国法院传票的管辖。

微软表示，由于储存此一客户资料的服务器是在爱尔兰首都都柏林，因此美国司法部门发出的传票没有管辖权。

但是法官詹姆斯法兰西斯说，针对电子邮件之类的线上数据资料发出的传票和其他传票不同。

法兰西斯说，这个传票比较像是要求交出文件的搜查票。他认为，按照美国联邦法律，只要收到搜查票，不论电邮这类线上文件储存在哪里，都必须交给司法部门。

他还表示，如果司法部门需要与外国政府协调，才能取得此类文件的话，会严重打击执法的能力、加重司法部门的负担。

报道说，微软在回复该社的声明中说“美国的检察官不能拿着美国发出的传票去搜查某个人位于其他国家的住宅，一样的，别的国家的检察官也不能拿着自己国家法院发出的命令到美国来搜查”。

微软称“我们认为这种规矩适用于线上世界，但是政府方面看法不同”。

爱尔兰是欧盟国家，而欧盟现正起草法律规定未来除非欧盟法律有明确规定或者是按照某个国际条约，不然企业不能将欧盟公民的资料交给其他国家。

欧盟委员会发言人安德瑞瓦表示，欧盟委员会的立场是，除非是通过类似司法互助的正式管道，不然不应该允许美国司法当局通过直接或者转交的方式取得资料。

微软将向地区联邦法院就此裁决提出上诉，希望能够推翻这次纽约南区法庭的裁决。
