男子申某利用QQ在互联网上非法购买1.5万余条公民个人信息，并将其转手卖给其他QQ好友，从中牟利约1500元。近日，市第二人民法院以非法获取公民个人信息罪判处申某有期徒刑1年，并处罚金3000元。

法院经审理查明，去年3月开始，现年35岁的湖南男子申某租住在大朗镇富安路某出租房，在互联网上向QQ昵称为“一直在努力”、“车主资料”等的好友非法购买1.5万余条公民个人信息，并将所购买的公民个人信息卖给QQ昵称为“金银满屋”等的好友，从中牟利约1500元。

同年9月，公安机关将申某抓获，在当场缴获的电脑里提取出113个存有公民个人信息的文档。

法院经审理认为，申某非法获取公民个人信息，情节严重，其行为已构成非法获取公民个人信息罪，依法应予惩处。根据现行刑法的规定，犯非法获取公民个人信息罪的，处3年以下有期徒刑或者拘役，并处或者单处罚金。申某归案后认罪态度较好，有悔罪表现，依法对其从轻处罚。
