　　受贿撤销网上追逃

　　2007年1月，深圳宝安区西乡街道第二工业区发生一起特大持枪抢劫案，陈某某价值130万元财物被抢。

　　深圳市公安局西乡派出所成立专案组，时任西乡派出所副所长的窦某浩指挥，时任西乡派出所案件侦查队负责人叶某雄主办此案。该案主犯彭某某(另案处理)及涉嫌销赃的嫌疑人李某某等人在逃。

　　据检方指控，当年6月，在逃嫌犯李某某托人找到窦某浩，请他帮忙撤销对其的网上追逃措施。窦某浩找到时任深圳市公安局宝安分局刑警大队综合科民警李某。尽管窦某浩未按规定提交证明材料，不符合办理撤销网上追逃的条件，民警李某仍帮忙撤销了李某某的网上追逃。窦某浩给民警李某好处费4000元。

　　盐田区人民法院审理查明，窦某浩、李某对明知是有罪的人故意包庇不使其受追诉。窦某浩构成自首，叶某雄、李某均不具有投案的主动性，不构成自首。三被告人同时构成徇私枉法罪、受贿罪。

　　一审判决，被告人叶某雄犯受贿罪，判处有期徒刑十年，并处没收个人财产2万元。被告人窦某浩犯受贿罪，判处有期徒刑一年八个月，并处没收个人财产1万元，犯徇私枉法罪，判处有期徒刑六个月。数罪并罚决定执行有期徒刑二年，并处没收个人财产1万元。被告人李某犯徇私枉法罪，判处有期徒刑七个月。
