　　审计署：云南5个县违规收取“超生罚款”

　　审计署派出审计组，自2012年5月29日至7月20日，对云南省会泽、彝良、腾冲、丘北、金平等5个县2009年至2012年5月的社会抚养费征收管理办法实施情况进行了专项审计调查。调查发现，云南5个县收取社会抚养费存在违规行为。

　　计划外生育人口上报数量不实

　　2009年至2012年5月，以上5个县共上报当期计划外生育人口1153人，但审计调查发现5个县当期有计划外生育人口4786人，少报、漏报3633人。此外，2009年至2012年5月，会泽、腾冲、丘北、金平等4个县计生部门共发现2009年以前计划外生育人口5913人，并立案征收了社会抚养费，但统计上报时未补报；会泽、腾冲等2个县还漏报2009年以前计划外生育人口252人。

　　云南省规定，城镇居民以全省城镇居民年人均可支配收入为基数，农村居民以州市农民年人均纯收入为基数计征社会抚养费。但省内部分贫困地区的实际收入水平与规定的基数标准相比，相差较大，5个县2011年城镇居民年人均可支配收入均低于全省平均水平，除腾冲县外的4个县2011年农民年人均纯收入低于所在州市平均水平。在征收社会抚养费时，贫困地区计划外生育人群缴纳的社会抚养费与其收入水平不相适应。如按计征基数和5倍的最低征收标准计算，金平县城镇居民应缴纳的社会抚养费是其收入的8.88倍，农村居民应缴纳的社会抚养费是其收入的9.1倍。

　　此外，征收单位自由裁量权较大，分期缴纳未按规定履行审批程序，且首付标准不统一。未按规定标准计征社会抚养费，少征105.35万元。

　　社会抚养费被挪用、坐支

　　云南省规定，代征机关应当在收到社会抚养费之日起两日内上缴国库。但是审计涉及的5个县在2009年至2011年，分别有10.18%、27.33%、12.41%的社会抚养费至年末都未上缴县财政，在征收人员、计生部门和财政专户等环节滞留，时间最长的达19个月。

　　而在未上缴款项中，部分资金被挪用、坐支。如云南省会泽县金钟镇、者海镇分别坐支社会抚养费及计生罚款63.71万元、53.18万元用于部门经费开支；金钟镇计生部门两名工作人员将所收330.2万元存入个人账户并因私挪用。而挪用的方式，则是五花八门。
