　　新华网北京11月29日电(记者崔清新)司法部副部长赵大程29日在新闻发布会上表示，社区矫正是刑罚执行的一个组成部分，它的法律依据、适用范围、运用程序、执行方式，都不同于劳动教养制度。

　　十八届三中全会决定提出：废止劳动教养制度，完善对违法犯罪行为的矫治和矫正法律，健全社区矫正制度。对此，有人担心社区矫正会否在劳教废止后，成为另一种形式的劳教。

　　在国新办举行的关于深化司法行政体制改革的新闻发布会上，赵大程回应称，两个制度是不能混同的，更不可能出现预测的这种情况。

　　他解释说，社区矫正是依照法律规定，把经过判决进行管制、宣告缓刑、假释和被暂予监外执行的轻刑犯、短刑犯，放到社会上进行矫正。是把那些主观犯罪意图不深、对社会没有太大危害的、刑罚处罚得比较轻的人，放到社会当中，让其回归到家庭中，接受一种不同于关在监狱中进行改造的特殊改造形式。社区矫正体现了对宽严相济刑事政策的贯彻落实。

　　赵大程说，劳教是对有违法行为，但又不构成犯罪的人采取强制教育，对其进行集中管理的措施，因此与社区矫正是有区别的。

　　据介绍，我国从2003年开始进行社区矫正试点工作，2005年扩大试点，2009年全面试行。刑法修正案(八)和修改后的刑事诉讼法对社区矫正制度均作出明确规定，确立了社区矫正法律制度。国务院已将社区矫正法列入国务院2013年立法工作计划。十二届全国人大常委会也已将该法律列入立法规划。

　　司法部提供的数据显示，截至今年10月底，各地累计接收社区服刑人员166.5万人，累计解除矫正100.7万人，社区服刑人员矫正期间再犯罪率为0.2%。
