　　上海文化创意产业法律服务平台知识产权调解中心暨上海经贸商事调解中心知识产权专业委员会昨日正式亮相中国(上海)自由贸易试验区，这也是国内首个国际商事调解机构。

　　上海经贸商事调解中心主任张巍在揭牌仪式上表示，经贸商事调解中心作为最高人民法院的试点单位，同时还是普通人民法院的特邀调解组织，将与自贸区法庭建立调解确认程序，使联合调解庭的调解书能在中国及与中国签订民商司法协助协定的国家和地区执行。

　　此外，经贸商事调解中心还将与相关的仲裁机构合作，对有需要在国外执行的调解书进行仲裁裁决确认。

　　张巍表示，由于中国政府已决定加入《纽约公约》，即承认并执行国外仲裁公约，所以中国的调解裁决将为140多个《纽约公约》加入国所承认和执行。

　　《纽约公约》即1958年6月10日在纽约召开的联合国国际商业仲裁会议上签署的《承认及执行外国仲裁裁决公约》，该公约处理的是外国仲裁裁决的承认和仲裁条款的执行问题。

　　上海市高级人民法院副院长盛勇强表示，自贸区虽然强调自由贸易，但同样对立法和司法提出挑战，其中之一便是纠纷解决机制。

　　“商人的交往必然会形成纠纷，纠纷需要有相应的组织和相应的机制来帮助解决。诉讼虽然是一种方式，但不是唯一方式，诉讼之外可以调解。”盛勇强说。

　　“调解是商人按照诚信来做约束，调解以后的执行率比法院诉讼的执行要高得多，几乎没有返回。”张巍在接受提问时表示。

　　据张巍透露，目前上海经贸商事调解中心已经接到香港律政司的邀请，将在香港成立分支机构。
