　　邵东法院审结首例“无名氏”民事案件

　　“无名氏”流浪人遭遇交通事故被“撞傻”，受害人身份不明、家属无法找到，“无名氏”的合法权益该如何救济？10月18日，湖南省邵东县法院成功审结首例涉“无名氏”人员民事案件，有效维护了“无名氏”的合法权益。

　　2011年5月17日晚，流浪人员“无名氏”在邵东县两市镇昭阳大道里安村地段横穿马路时，被李某驾驶的车辆当场撞翻在地。“无名氏”随即被送往医院抢救。经诊断，“无名氏”有重型颅脑损伤 ；左桡骨、耻骨骨折，左股骨下段骨折；多处软组织挫伤。

　　“无名氏”住院治疗共计65天，用去医疗费71000余元，出院后经法医评定为4级伤残，完全护理依赖。因颅脑受损，“无名氏”已完全丧失表达能力，无法表述自己的身份情况，公安机关根据其体貌特征，走访知情人，发布公告，但最终无法打探到亲属下落。保险公司、肇事车主、交警部门在短期内结案显得心有余而力不足，“无名氏”的身份无法查明，自身又无法主动行使权利，最终致使案件一度陷入泥潭。

　　交通事故诉前调解中心的法官们群策群力，及时联络邵东县民政局协调，由该局将伤愈的“无名氏”妥善安置在该县的兴隆村养老院护理，同时做通车主李某的思想工作，由其垫付了“无名氏”的生活费与护理费。

　　法官还主动承担起该案的诉讼业务指导，在无法查明“无名氏”近亲属和住所地的情形下，根据《中华人民共和国民法通则》关于监护的相关规定，向邵东县民政局做法律释明工作，使该局同意担任无名氏的监护人，解决了诉讼参加人的资格问题。

　　案件宣判后，事故处理各方均表示满意，息诉服判。经法院与民政局再次协调，在“无名氏”亲属未出现之前，由民政局设立专门账户保管“无名氏”的赔偿款，用于“无名氏”的治疗与护理。
