　　中新社郑州10月23日电 (记者 李贵刚)河南省高级人民法院23日对外公布了该省三种犯罪认定数额新标准，即日起将在全省开始施行。其中，挪用公款10万元人民币(下同)属于“情节严重”的情形之一。

　　此次公布的三种犯罪认定数额新标准包括敲诈勒索罪、诈骗罪和挪用公款罪。新的标准规定，敲诈勒索公私财物价值5万元、诈骗公私财物价值5万元和挪用公款20万元均属“数额巨大”。

　　与出台之前的数额标准相比较，在“数额较大”方面，上述三罪名的起点数额增加幅度不大；在“数额巨大”和“数额特别巨大”方面，敲诈勒索罪的起点由2万元增至5万元，诈骗罪的起点20万元增加到50万元，均翻一倍多。

　　关于挪用公款犯罪，新标准也作出了相应“微调”，规定挪用公款归个人使用，“数额较大，进行营利活动的”，或者“数额较大、超过3个月未还的”，以挪用公款3万元为“数额较大”的起点，以挪用公款20万元为“数额巨大”的起点。

　　“挪用公款归个人使用，进行非法活动的”，以挪用公款1万元为追究刑事责任的数额起点。挪用公款10万元以上，属于挪用公款归个人使用，进行非法活动“情节严重”的情形之一，这与出台之前的数额标准也翻了一倍。

　　河南省高级人民法院一负责人解释称，上述三个罪名在实践中是较为常见、非常复杂、也存在较多争议的罪名。在新标准出台前，适用的数额认定标准是1998年、1999年及2000年时确定的标准。但是，随着经济社会的不断发展，与1997年相比，全国城镇居民人均可支配收入和农村居民人均纯收入分别增长了4.6倍和3.7倍。在这种情况下，作为涉及财产利益的犯罪，上述三个罪名原来的数额认定标准已经不能适应案件审理的需要，其定罪量刑标准的设定也应当作出相应的调整。(完)
