新华网北京10月23日电(记者涂铭)备受关注的中石化“非洲牛郎门”谣言案23日在北京市朝阳区法院一审宣判。法院认定发布相关谣言文章的IT商业新闻网、中华网侵权成立，判决两家网站的主办公司向原告张某道歉并分别赔偿其3万元和1.5万元。
2013年初，网络曝出“中石化女处长身陷牛郎门”的消息，称中国石化国际事业公司一女处长在相关招投标项目中接受投标企业“非洲牛郎”性贿赂，而后帮助该企业非法中标。事后，制造该谣言的犯罪嫌疑人傅学胜被上海市公安机关依法刑事拘留。
据了解，事发后，中国石化国际事业公司招投标处处长张某先后将涉嫌发布相关文章的“IT商业新闻网”“中华网”的主办公司北京大东半岛科技有限公司(简称大东半岛公司)、北京华网汇通技术服务有限公司(简称华网汇通公司)诉至法院，认为该消息失实，对其造成了严重的影响，要求二被告消除影响、恢复名誉，并要求大东半岛公司赔偿精神损害抚慰金3万元、华网汇通公司赔偿精神损害抚慰金7万元。
在庭审中，大东半岛公司认为其发布的文章系转载，且为平衡客观报道，不同意张某的诉讼请求。华网汇通公司认为其未收到张某的通知，不同意张某的诉讼请求。
法院审理后认为，IT商业新闻网在未真实采访及核实的情况下，引用所谓“爆料者”的语言，其中充斥着侮辱性语言甚至低俗的性贿赂细节描写，明显超过了新闻报道范畴，涉案文章内容不构成平衡客观的新闻报道，且包含贬损原告张某人格的不公正评论，其行为已经构成对张某名誉权的损害。法院同时认定，华网汇通公司有关“邮箱业务外包及网络故障导致未收到邮件”的主张不能成立，应就未及时删除相关侵权文章承担法律责任。据此作出上述判决。
