　　2017年2月21日，北京市第二中级人民法院公开宣判国家安全生产监督管理总局原局长杨栋梁受贿、贪污一案，对被告人杨栋梁以受贿罪判处有期徒刑十三年六个月，并处罚金人民币一百八十万元；以贪污罪判处有期徒刑三年，并处罚金人民币二十万元,决定执行有期徒刑十五年，并处罚金人民币二百万元；对杨栋梁受贿所得财物及其孳息予以追缴，上缴国库；贪污所得财物依法返还被害单位。杨栋梁当庭表示服判，不上诉。

　　经审理查明：2002年至2015年，被告人杨栋梁先后担任天津市副市长、天津市委常委、常务副市长、天津陆军预备役高炮师第一政委、国家安全生产监督管理总局局长、党组书记期间，利用职务上的便利，为相关单位和个人在企业经营、职务调整、承揽工程等事项上提供帮助，非法收受他人给予的财物共计折合人民币2849万余元。

　　1999年4月，被告人杨栋梁在担任天津市经济委员会主任期间，以所在单位向天津市工业房地产开发总公司多划拨25万元基建款的方式，购买了位于天津市和平区新疆路保疆里小区5-501房屋一套，并未进行国有资产登记。2001年4月，杨栋梁调离市经委主任时，未向天津市经委移交该房产。天津市经委也不掌握该房屋。经鉴定，该案房产价值人民币27.08万元。

　　北京市第二中级人民法院认为，被告人杨栋梁的行为构成受贿罪和贪污罪。鉴于杨栋梁到案后能够如实供述自己罪行，并主动交代办案机关尚未掌握的部分受贿犯罪事实;认罪悔罪，积极退赃，赃款赃物已全部追缴，具有法定、酌定从轻处罚情节，依法可以从轻处罚。法庭遂作出上述判决。
