　　新华社呼和浩特10月31日电（记者刘懿德）记者31日从内蒙古自治区鄂尔多斯市中级人民法院获悉，当日该院一审公开宣判了呼和浩特市委原副书记、市政府原市长汤爱军受贿案，判决汤爱军犯受贿罪，判处有期徒刑12年，并处罚金100万元；对被告人汤爱军退缴的涉案赃款及孳息依法予以没收，上缴国库。

　　法院经审理查明：1997年6月至2000年2月，被告人汤爱军任内蒙古自治区人民政府副秘书长；2000年2月至2003年4月，任内蒙古自治区国防科工办主任；2003年4月至2005年1月，任呼伦贝尔市委副书记、市长；2005年1月至2010年4月，任呼和浩特市委副书记、代市长、市长；2013年12月退休。

　　1999年至2013年，被告人汤爱军利用担任上述职务的便利及职权或地位形成的便利条件，在承揽工程、安排调动工作、干部提拔使用、子女入学等方面，为呼伦贝尔市呼盛矿业有限责任公司董事长赵广玉、内蒙古万铭实业有限责任公司法定代表人邬倩、李建勇等59人（企业）谋取利益，并收受他人财物，价值共计1789.99104万元。

　　法院认为，汤爱军身为国家工作人员，利用职务上的便利，非法收受他人财物，为他人谋取利益；利用本人职权或地位形成的便利条件，通过其他国家工作人员职务上的行为，为请托人谋取不正当利益，收受请托人财物价值1789.99104万元，数额特别巨大，其行为构成受贿罪。

　　案发后，汤爱军在办案机关未掌握的情况下，主动交代本案大部分犯罪事实，系坦白，依法从轻处罚；汤爱军在本案侦查过程中积极规劝其妻子王荣杰、儿子汤聪、相关证人、亲友配合办案机关的调查取证工作，认罪、悔罪态度好，依法酌情从轻处罚；汤爱军积极规劝相关人员退回赃款，现全部赃款已上缴，并上缴了相关孳息，依法酌情从轻处罚。

　　法院依法作出上述判决后，被告人汤爱军当庭表示不上诉。
