根据香港《个人资料（隐私）条例》规定，服务商在用户账号注销之后，用户资料最多可以保存7年，服务商个人资料保存时间不得超过其所需要的时间，由此可见，支付宝的资料存储时间已经超过了规定时限。
对此，蚂蚁金服旗下支付宝对外回应称，“涉及洗黑钱、反恐相关的嫌疑账号，支付宝依据国际惯例，有永久保存的权利。”
但同时支付宝还表示：“支付宝一贯慎重对待用户个人资料，严格保障用户隐私安全，并严格依据有关的香港和国际法例，包括《个人隐私条例》、反洗钱和反恐怖融资法规以及税法和支付宝的相关政策，保存用户个人信息七年。”
另外，支付宝人士称，目前与香港消费者委员会的沟通当中出现问题，支付宝人员误将所有用户都写成了“永久保存”，未来将会进一步沟通。
