　　法制网石家庄9月8日电 记者周宵鹏 记者今天从河北省高级人民法院获悉，根据中国最高人民法院下达的执行死刑的命令，邯郸市中级人民法院于日前对邯郸21人杀害矿友骗赔案主犯张伟兰、赵俊、张成勇、徐城德、闫仕勇等五人执行死刑。

　　2014年8月7日，邯郸中院对该案作出一审判决，以故意杀人罪分别判处被告人张伟兰、赵俊、张成勇、徐城德、闫仕勇死刑，剥夺政治权利终身。宣判后，被告人张伟兰、赵俊、张成勇、徐城德、闫仕勇等提出上诉。河北高院经依法开庭审理，于2015年5月12日作出刑事裁定，驳回上诉，维持原判。中国最高人民法院依法组成合议庭，对本案进行了复核，依法讯问了被告人，听取了辩护律师的意见。

　　中国最高人民法院经复核确认，2011年7月至2012年6月间，被告人张伟兰、赵俊、张成勇、徐城德、闫仕勇及同案被告人闫登鹏、陈荣来、王朝松、秦秀琼、王华涛、王正富、王正秀、黄元才、李天才、谢友贵（均已被判刑）相互纠集、分别结伙，以打工为名先后将四名被害人骗至河北省邯郸武安市，利用在井下干活期间，将被害人杀害，伪造矿难假象。后由张伟兰、王华涛、王正富、闫登鹏、秦秀琼及同案被告人张国全、马晓丹、马金花、罗时永、向坤、向小蓉（均已被判刑）冒充死者亲属，共向矿方骗取赔偿金180万元。

　　中国最高人民法院经复核认为，被告人张伟兰、赵俊、张成勇、徐城德、闫仕勇故意非法剥夺他人生命的行为均构成故意杀人罪。张伟兰、赵俊、张成勇、徐城德、闫仕勇采用诱骗他人下矿井打工，将其杀害后，假冒矿难的手段骗取钱财，犯罪性质极其恶劣，情节、后果特别严重，社会危害极大，应依法惩处。张伟兰组织、策划、纠集他人故意杀人四起，致四人死亡，诈骗赔偿金180万元，在共同犯罪中地位、作用最为突出。赵俊积极实施、参与共同故意杀人四起，致四人死亡，其中直接实施对被害人的加害行为三起，系共同犯罪中地位、作用突出主犯。张成勇积极实施、参与共同故意杀人四起，致四人死亡，其中直接实施对被害人的加害行为二起，系共同犯罪中地位、作用突出的主犯。徐城德积极实施共同故意杀人二起，致二人死亡，且均直接对被害人实施了加害行为，系共同犯罪中地位、作用突出的主犯，虽有立功情节，但不足以从轻处罚。闫仕勇积极实施、参与共同故意杀人三起，致三人死亡，其中直接或参与实施对被害人的加害行为二起，系共同犯罪中地位、作用突出的主犯。

　　中国最高人民法院认为，第一审判决、第二审裁定认定的事实清楚，证据确实、充分，定罪准确，量刑适当，审判程序合法。依照《中华人民共和国刑事诉讼法》和《中国最高人民法院关于适用〈中华人民共和国刑事诉讼法〉的解释》的有关规定，核准河北省高级人民法院维持第一审以故意杀人罪分别判处被告人张伟兰、赵俊、张成勇、徐城德、闫仕勇死刑，剥夺政治权利终身的刑事裁定。
