　　中新网兰州8月16日电（记者 崔琳） 8月16日，兰州市中级人民法院依法公开审理了甘肃省公共气象中心原副主任、兼任甘肃省防雷中心主任张华，被告人甘肃欣优诺电子科技有限公司法定代表人薛洪飞贪污窝案，兰州市纪委组织市直机关50多名负责人旁听此案。

　　当天上午9：30分，随着一声法鎚落定，此案开审，现年50岁的被告人张华与41岁被告人薛洪飞被带上法庭。庭审中，张华认为其是按照气象局及防雷中心的规定发放奖金，并对公诉机关指控的贪污数额提出异议。共犯薛洪飞对指控实事没有异议，并当庭认罪，此案未当庭宣判。

　　公诉机关指控，2010年12月、2012年12月，张华利用其担任甘肃省防雷中心主任的职务便利，与被告人薛洪飞共谋，通过甘肃省防雷中心与 甘肃省欣优诺电子科技有限公司先后两次签订虚假合同，骗取甘肃省气象局公款合计73.4万元。其中，张华分得近66.2万元，薛洪飞以缴纳税款及手续费名 义分得约6.98万元。

　　同时，2011年至2014年，张华利用担任甘肃省防雷中心主任的职务便利，指使该中心副主任张某（另案处理），联系甘肃中汇电子科技工程有限 公司总经理申某（另案处理），先后六次使用虚假合同、发票骗取甘肃省气象局公款合计约116.82万元，其中，张华分得近100.36万元，申某以缴纳税 款名义分得约16.47万元。

　　上述两起犯罪，张华共分得约166.5万元，并以所谓奖励、公关支出，好处费等名义再将其中的7万元分给张某，16万元分给叶某（另案处理），5000元分给万某。

　　此外，2011年11月至2014年5月，张华与时任甘肃省防雷中心宁安检测站站长李某（另案处理）共谋，先后十一次使用虚假合同、发票骗取甘 肃省气象局公款共计近75.2万元，张华分得50.85万元。2013年6月至2014年12月，张华与甘肃省防雷中心技术服务部负责人李某（另案处理） 共谋，先后七次使用虚假合同、发票骗取甘肃省气象局公款共计近61.1万元，其中，张华分得28.18万元。

　　立案前，张华向甘肃省气象局退缴赃款58.87万元，立案侦查后，侦查机关查扣张华位于陕西省西安市临潼区房产一套。

　　检察机关认为，被告人张华身为国家工作人员，在担任甘肃省防雷中心主任期间，利用职务便利，骗取公款共计约326.47万元，数额特别巨大，被告人薛洪飞与国家工作人员勾结，伙同贪污共计73.4万元，数额巨大，应当以贪污罪追究二人刑事责任。（完）
