今年3月份，保定中级人民法院做出终审裁定，以徇私舞弊不移交刑事案件罪判处孙某有期徒刑1年2个月。
《法制晚报》（微信ID：fzwb_52165216）记者获悉，去年12月29日，河北省纪委宣布，给予刘军臣开除党籍、行政开除处分，涉嫌犯罪问题、线索及所涉款物移送司法机关依法处理。

不移交案件自称考虑同乡关系
孙某口中的刘某到底是谁？

尽管明知森农公司的违法占地情况已被监控卫星拍下，此案是河北省国土厅督办案件，在省国土厅有备案，违法占地面积已超过10亩应该作为刑事案件移交公安机关处理，但孙某仍未将案件移交，还一直在帮刘军臣办手续。
上述内容，与刘军臣的证言一致。孙某说，如果刘军臣没给他打电话，他肯定会把这个案子正常移交公安机关。他当时是考虑到自己和刘军臣的同乡关系，以及刘军臣在当地的影响力。
他还承认，自己曾找刘军臣办过私事。一次，他和家人开车外出旅游被高速交警查处，就是联系刘军臣解决的。
局长为帮山庄征地而弄虚作假
孙某交代，他曾告诉刘军臣，得先经过处罚程序和土地征用程序才能补办合法手续。刘军臣同意，并向孙某催办。
为了通过处罚程序，2011年5月20日、27日，孙某分别签发行政处罚听证告知书和行政处罚决定书，对丽元山庄作出没收非法占用土地上的建筑物、构筑物，按每平米10元标准罚款的行政处罚。
双桥区国土局履行完处罚程序后，便开始走土地征用程序。但在向河北省国土厅上报的过程中，省国土厅提出，材料中缺一份公安机关对丽元山庄违法占地的立案证明。
根据刘军臣的证言，他了解情况后给双桥区公安局的一位领导打了电话，在公安局办出了所谓的“立案证明”。
随后，河北省国土厅批准了丽元山庄的征地手续。
根据执法监察大队大队长赵某的证言，该局对森农公司的处罚决定书中，写明的处罚面积是14466平方米。为了帮森农公司多征地，局长孙某让其另外制作了一份处罚决定书，把面积改为了20666平方米。
孙某事后承认，两份处罚决定书的案号相同，完全是为了帮森农公司征地而弄虚作假。
司法处理
国土局长终审获刑1年2个月
2015年1月22日，孙某因涉嫌徇私舞弊不移交刑事案件罪，被河北省保定市检察院指定居所监视居住，2015年2月15日被执行逮捕。
2016年3月23日，保定市中级法院终审以徇私舞弊不移交刑事案件罪判处孙某有期徒刑1年2个月。刘某、王某被另案处理。
徇私舞弊不移交刑事案件罪，在司法实践中很少出现。专门承办土地、拆迁类案件的北京京平律师事务所主任赵健告诉记者，该罪是指行政执法人员徇私舞弊，对依法应当移交司法机关追究刑事责任的不移交，情节严重的行为。
对此案，赵健解读称，孙某和刘某是同乡、刘某找孙某办理合法用地手续、两人合谋出具假的公安立案证明、篡改案件移送及结案时间等事实，能够证实孙某具有徇私舞弊的故意和行为。
双桥区国土局已于2015年2月10日将森农公司违法占地案移送至双桥区公安分局，移送书载明森农公司违法占地9209平方米，已经超过10 亩，森农公司已涉嫌非法占用农用地罪。行政机关在执法过程中发现违法行为涉嫌构成犯罪，就负有移送相关司法机关的义务。由此可以看出，孙某具备徇私舞弊不 移交刑事案件罪的客观要件。
赵健表示，对徇私舞弊的国土系统官员进行刑事追责，可以对官官相护、官商勾结现象起到震慑作用，有利于解决一些土地、拆迁纠纷矛盾。

至于王某和其丈夫刘军臣，目前已被另案处理。
2015年02月11日，河北省人民检察院发布消息称，日前，河北检察机关决定，依法对刘军臣（正处级）涉嫌受贿犯罪立案侦查。2015年12月18日，保定市人民检察院决定，依法对刘军臣（正处级）以涉嫌受贿罪、贪污罪向保定市中级人民法院提起公诉。
2015年12月29日，河北省纪委宣布，其对刘军臣严重违纪问题进行了立案审查。
经查，刘军臣严重违反廉洁纪律，利用职务上的便利，非法占有公共财物和其他公司财物，利用职务上的便利为他人谋取利益并收受财物，收受礼金、礼品。其中，利用职务上的便利，非法占有公共财物；利用职务上的便利为他人谋取利益并收受财物问题涉嫌犯罪。
