　　江西九江县新洲垦殖场下发了一份通知，要求长江九江站水位达到21.5米时，外出务工人员必须无条件回乡参加防汛，否则将受到一系列的严厉处置。

　　洪水来袭，抗洪确实是一件大事，可以说是“人人有责”。但地方要求在外打工的人员限期回乡参加抗洪，这样的事还是不多见。抗洪是不是就靠人多，打工者回乡抗洪是不是很有必要，这真的需要好好研究。

　　的确，如果外出打工的青壮劳力都回乡了，对抗洪肯定是有好处的，起码可以帮助转移老人孩子、照顾家人。同时，作为在外的打工者，当家乡发生洪 水，自然也会关心亲人的安危，关心村里的抗洪，如果可能，他们肯定愿意回家乡的。只是由于种种现实原因，比如交通问题，费用问题等，有可能使得他们想回而 不能。

　　而更为奇怪的是，九江县委宣传部门工作人员的相关说法。工作人员称，这是村里的乡规民约，也是《防洪法》里的第45、52条规定。但事实上， 《防洪法》第45条的有关规定是“在紧急防汛期，防汛指挥机构根据防汛抗洪的需要，有权在其管辖范围内调用物资、设备、交通运输工具和人力”。显然与相关 处罚措施无关。

　　至于其引用的第52条规定，即“有防洪任务的地方各级人民政府应当根据国务院的有关规定，安排一定比例的农村义务工和劳动积累工，用于防洪工程 设施的建设、维护。”事实上，这是旧版的规定，2015年的新版已经取消了。这是因为在农村税费改革之后，农村的义务工和劳动积累工已经变成了“一事一议 筹劳”，是村内公共事业费用。

　　此外，九江的工作人员还表示，这是“村民自己约定的，不是政府在管”，但即便如此，倘若村规民约不正确，政府也应予以纠正。《村民委员会组织 法》第二十七条说，“村民自治章程、村规民约以及村民会议或者村民代表会议的决定不得与宪法、法律、法规和国家的政策相抵触，不得有侵犯村民的人身权利、 民主权利和合法财产权利的内容。村民自治章程、村规民约以及村民会议或者村民代表会议的决定违反前款规定的，由乡、民族乡、镇的人民政府责令改正。”

　　如此看来，尽管抗洪是紧急情况、特殊情况，但作为农村基层组织还是要依法办事，不能随意侵犯老百姓的权利。有话，要好好说。
