新京报讯 (记者刘洋)儿子要去巴厘岛蜜月旅行，作为副局长的父亲不用自掏腰包，供应商直接给美金消费。新京报记者昨日获悉，北京市民防局原副局长程拴牢利用职务之 便，收受企业和个人给予的现金、楼房、美元等财物折合人民币共计93万余元，因受贿罪被三中院一审判处有期徒刑两年半。
授意供应商提价 趁机索贿
59岁的程拴牢案发前是北京市民防局副局长，其先后担任了北京市人民防空办公室指挥处处长、地下空间开发管理处处长、北京市民防局工程建设处处长。
法院查明，2005年1月至2013年7月，程拴牢利用担任北京市人民防空办公室指挥处处长、地下空间开发管理处处长、北京市民防局工程建设处 处长、副局长等职务上的便利，为北京某防护设备有限公司、李某等单位和个人在获取人防工程防护设备定点生产企业资质、承揽采购项目等方面提供帮 助；2005年3月至2015年6月，程拴牢非法收受上述单位负责人和李某等人给予的人民币23.7万元、美元0.5万元，以及价值人民币66万元的财 物，共计折合人民币93万元；2015年9月1日，程拴牢因涉嫌犯受贿罪被刑事拘留。案发后，涉案赃款赃物已被追缴或由程拴牢的亲属退缴在案。
其中，曾在一起防空地下室标识牌采购项目中向程行贿的李某称，他在和程拴牢谈合同时，程拴牢跟他压价，将要签订合同前，程拴牢又让他把每块标识 牌提高5元，等他收到货款后将多出来的钱作为回扣给程拴牢。在合同签订后，市民防局将第一笔款支付给他后，程拴牢向他要8万元，给了他账号，于是李某将钱 汇给了程拴牢。
“买”房不给钱 找人付款
不仅要钱，程拴牢还要房。根据指控，2007年10月至2009年4月，程拴牢利用其担任北京市民防局工程建设处处长职务上的便利，接受北京某 公司股东赵某的请托，为该公司申请并取得人防工程防护设备定点生产和安装企业资格提供帮助。2007年11月，程拴牢收受赵某给予的密云价值60万元的住 房一套。
赵某说，当时，程拴牢到公司检查工作时，对赵某说他觉得密云环境不错，想在密云买套房，让赵某帮忙看房源。而赵某帮其看上房后，程拴牢又以炒股 手头紧为由，让赵先把房款付了。房子名字写着程拴牢的，购房合同也是他签的，赵某说，他从未想过程拴牢会将房款还给他，实际上也并没有给他。
2015年，程拴牢的儿子去巴厘岛蜜月旅行，程也拿了供应商钱。据证人谢某说，他做人防产品，2014年下半年，程拴牢给他介绍了个房山的项目，经过程拴牢的关系，这个项目审批手续很快下来。这时恰逢程的儿子要蜜月旅行，他就带着5000美元在程的办公室给了他。
法院认为，程拴牢的行为已构成受贿罪。一审以受贿罪，判处程拴牢有期徒刑两年半，罚金10万元。
