许镜清诉称，2015年12月初，蓝港在线北京科技有限公司创作并出品发行的游戏《新西游记》，未经其授权、未署名使用86版电视剧《西游记》的《西游记序曲》、《猪八戒背媳妇》等两首作品作为配乐贯穿游戏始终。为此，许镜清要求被告停止侵权，在其官网及其他所有网络中删除侵权游戏《新西游记》，登报赔礼道歉并连带赔偿经济损失160万。

7月5日，石景山法院开庭审理里该案件。庭审中，蓝港在线表示，2015年12月接到原告方告知后，发现确实因为自身疏忽而未做相关授权，当即删除了游戏中的两首涉案作品。此外，为了合法使用本案两首涉案作品，蓝港在线分别在2009年6月3日和2011年5月19日同音著协签订了授权协议，获取了相关音乐授权。只是后来公司业务中心转移到手机游戏，所以造成涉案曲目“超期使用”并未故意“侵权”。

目前该案仍在审理中，法院将择期作出判决。
