7月5日消息，日前，北京海淀法院审结了原告北京瑞平国际拍卖行有限公司诉北京搜房科技发展有限公司不正当竞争纠纷案，判决搜房公司停止不正当竞争行为，赔偿瑞平公司经济损失100万元等。

据海淀法院网通报，原告瑞平公司系一家具有一定知名度的AAA资质的拍卖公司，该公司曾于2012年与搜房公司合作，由瑞平公司为搜房公司在搜房网开展的“搜房拍”房产拍卖活动提供网络拍卖服务支持。然而双方合作一年期满后没有续约，但搜房网并未及时撤回搜房网上的瑞平公司企业名称等信息，仍将搜房公司作为“搜房拍”活动的合作伙伴，在近两年期间共组织房产拍卖400余场次，成交金额超过3.8亿元。

对此，瑞平公司认为搜房公司的行为仿冒了其企业名称，故而将搜房公司诉至法院，请求判令搜房公司停止不正当竞争行为，并赔偿其经济损失及合理费用共计200万元。

搜房公司抗辩称由于公司员工离职交接疏忽，未撤回搜房网上瑞平公司的相关信息，故其主张上述行为并不构成仿冒瑞平公司企业名称，仅构成虚假宣传。

法院经审理认为，搜房公司在搜房网中使用了瑞平公司的企业名称，且存在主观过错。特别是搜房公司在“搜房拍”活动的“竞拍规则说明”中明确该活动适用《拍卖法》及相关法规，瑞平公司提供全程服务支持，同时也向与其合作的房地产开发商明确存在与其合作的拍卖行。搜房公司已使包括竞买人、委托人在内的相关公众误认为瑞平公司是为“搜房拍”活动提供拍卖服务支持的拍卖人。因此，搜房公司的行为仿冒了瑞平公司的企业名称。由于搜房公司的行为不是仅以瑞平公司为名为“搜房拍”活动进行宣传，而是该活动的一方重要主体，因此法院对搜房公司关于虚假宣传的辩称不予支持。法院最终考虑到搜房公司行为的持续时间，涉及房产拍卖的场次、金额以及行为的恶意程度等作出上述判决结果。

本案一审宣判后，双方未表示是否上诉。

海淀法院表示，本案为我国首例网络拍卖不正当竞争纠纷案，不仅涉及仿冒他人企业名称与虚假宣传不正当竞争行为的认定，而且反映出当前网络拍卖的现状，为网络拍卖立法规则的确立提供了实践素材。
