中国野生动物保护法：将出台动物价值标准以定处罚

　　人民网北京7月2日电（记者 刘茸）今天下午，中国全国人大常委会第二十一次会议闭幕会以152票赞成、1票反对、4票弃权，表决通过了新修订的野生动物保护法。在会后召开的新闻发布会上，国家林业局保护司总工程师严旬表示，下一步要出台一个野生动物价值的衡定标准，以这个标准来规范执法，做出处罚。

　　根据修改后的该法规定，违法捕获国家野生动物的，处以捕获价值2倍到10倍的罚款。严旬表示，现实执法中确定野生动物价值经常遇到难题，例如，内蒙古有一种百灵鸟叫蒙古百灵，很多不法分子把这种鸟抓到以后，拿到广东销售。如果在内蒙古，它的原产地价格比较低，可能是几十块钱，拿到广东非法市场上出售的价格比较高，一只百灵能够卖到几百块钱。

　　他解释说，在这种情况下，执法过程中在哪一地抓到，则按照当地的价格判断，如果不是特别好判断，就在几个省范围内对这种动物销售的价格取一个平均值。下一步我们要出台一个野生动物价值的衡定标准，以这个标准来规范执法，做出处罚。

　　此外，未来五年内会定期调整国家重点保护野生动物的名录，该名录出台以来已经有27年没有正式修订过，仅在2003年就麝进行过一次调整。

　　严旬表示，目前我国对野生动物实行分级、分类保护，国家重点保护的野生动物分一级和二级。一级的如果是想因科学研究要猎捕，或者捕捉，是由国务院的野生动物保护主管部门负责批准；二级的国家重点野生动物保护是由省级野生动物保护主管部门批准；同时给省人大预留了地方重点的保护动物管理空间。

　　各省、自治区人大可以根据自己的区域和各物种的情况，设定地方野生动物保护野生动物名录。还有一种情况，由国务院野生动物主管部门负责调整，具有生态和科学研究，以及社会价值的这种野生动物，俗称“三有”，这个范围比较广，现有的“三有”名录涵概了1700多种动物。

　　下一步调整的目的是：对极度濒危的、原来等级比较低的动物，如江豚，从二级提升到一级，有一些鸟类数量非常少，可能从“三有”名录中调整到国家一级；对有一些物种可能要降级，比如部分物种人工饲养的数量非常大，如梅花鹿，对人工种群可能要调出重点保护动物的范围。下一步根据野生动物保护法的要求五年内要评估，数量多了要降档，数量少了要提档。
