China's wildlife protection law amendment Bill passed

中国野生动物保护法修订草案通过

　　7月2日下午，野生动物保护法修订草案（下称修订草案）经十二届中国全国人大常委会第二十一次会议表决通过。表决结果显示，152票赞成，1票反对，4票弃权。

　　新修订的野生动物保护法包括总则、野生动物及其栖息地保护、野生动物管理、法律责任、附则五章内容，将于2017年1月1日起施行。

　　当天下午4时，中国全国人大常委会办公厅在人民大会堂台湾厅举行新闻发布会，邀请中国全国人大环资委、国家林业局等相关部门负责人回答与野生动物保护法修订草案有关的问题。

　　澎湃新闻（www.thepaper.cn）此前报道，野生动物保护法自1989年3月1日起施行，仅于2004年对单项条款做过一次修改，内容严重滞后，被动物保护者、法律界人士诟病为“为利用而保护”。西北政法大学教授、动物保护研究中心主任孙江曾公开指出，野生动物保护法不仅在立法目的上表现得过于单一和功利化，还存在着保护力度不足、动物致害补偿不完善、缺乏操作性、主管部门权责界定不清等多方面问题。

　　6月27日下午，第十二届中国全国人大常委会第二十一次会议对三审稿进行分组审议。当天上午全体会议上，中国全国人民代表大会法律委员会关于修订草案审议结果的报告显示，法律委员会经同环境与资源保护委员会、国务院法制办公室、农业部、国家林业局研究，建议删去修订草案二次审议稿第一条立法目的中的"规范野生动物资源利用”一句；将第四条中的“合理利用”改为“规范利用”。
