此前在2014年的6月份，英特尔曾就此上诉了欧盟的常设法院（EU's General Court），而该法院驳回了其申诉请求，维持原判。如今英特尔再度提起申诉，此次该案件将拿到欧盟最高法院进行审理。（注：欧盟的常设法院是欧盟法院的下设机构）

在2009年的反垄断调查中，欧盟的调查机构发现在2002年10月份到2007年的10月份之间，英特尔利用自己在X86处理器市场的垄断地位排挤其竞争者AMD，当时英特尔芯片份额达到了70%。

欧盟最高法院将会按照相关程序进行审理，如果这次英特尔的诉求仍被驳回，那么这一判决将无法更改。
