National Bureau of statistics announced on May 13, 2016, 2015 national urban-sector unit annual average wage of fully employed staff for 63241 Yuan. According to the legal requirements mentioned above, statistical data, and human resource and Social Security Department of the daily average wage formula, belonging to the State compensation cases of violations of citizens ' personal freedom, the highest criminal appeals Prosecutor's Office established a new compensation standards for 242.3.

最高检：侵犯公民人身自由每日赔偿242.3元

　　新京报快讯(记者王梦遥)最高人民检察院5月16日下发通知，要求各级人民检察院办理自身作为赔偿义务机关的国家赔偿案件时，执行新的日赔偿标准242.3元，该标准较上年度增加了22.58元。

　　据最高检刑事申诉检察厅有关负责人介绍，国家赔偿法第三十三条规定：“侵犯公民人身自由的，每日赔偿金按照国家上年度职工日平均工资计算。”

　　国家统计局2016年5月13日公布，2015年全国城镇非私营单位在岗职工年平均工资为63241元。根据上述法律规定、统计数据以及人力资源和社会保障部提供的日平均工资的计算公式，对属于侵犯公民人身自由的国家赔偿案件，最高检刑事申诉检察厅确定了新的日赔偿标准为242.3元。

　　另据《最高人民法院、最高人民检察院关于办理刑事赔偿案件适用法律若干问题的解释》第二十一条第二款规定，各级人民检察院自2016年5月16日起执行该日赔偿标准。
