　　新京报快讯(记者李禹潼)北京昌平区东小口镇中滩村原党支部书记张亮，任职期间以断水电、拆房屋等方式干扰村里租户正常生活，向租户索要人民币50万;并通过他人向旅行社索要2万元回扣。今天上午，北京二中院以非国家工作人员受贿罪，终审判处张亮有期徒刑3年半，没收5万元，同时追缴12万元非法所得。

　　据检方指控，张亮今年52岁，北京人，中专文化，被捕前系昌平区东小口镇中滩村党支部书记、村民委员会主任、东小口镇人大代表。因涉嫌寻衅滋事罪，于2014年12月18日被羁押；因涉嫌敲诈勒索罪，于2015年1月24日被逮捕。现押于北京市丰台区看守所。

　　检方指控张亮的犯罪事实有两项，2010年4月，张亮身为北京市昌平区东小口镇中滩村党支部书记、村民委员会主任，其利用职务便利，将高某某在中滩村承租的大院断水断电，还通过在大院门前挖沟、拆毁房屋等方式，干扰大院的正常经营，以此向高某某索要钱款共计人民币50万元。收取该笔钱款后，张亮恢复了该大院的正常经营秩序。

　　2010年4月，张亮用其职务便利，通过刘某某报名北京浩海旅行社旅游团，组织中滩村党员赴云南旅游。其间，张亮通过刘某某向北京浩海旅行社索取回扣共计人民币2万元。

　　公诉机关认为，张亮的行为已构成非国家工作人员受贿罪，应依法予以惩处。

　　一审时，张亮对公诉机关指控的事实均予以否认。法院经审理，以非国家工作人员受贿罪，判处张亮有期徒刑5年，并没收财产5万元;同时，继续追缴张亮违法所得12万元，予以没收。

　　一审宣判后，张亮不服提出上诉，今天上午10点20分左右，该案在北京二中院开庭，张亮的两名亲属到庭旁听。

　　11点50分，二中院以非国家工作人员受贿罪，终审判处张亮有期徒刑3年半，没收财产5万元，并继续追缴张亮违法所得12万元，予以没收。
