  中新社北京5月11日消息,针对美官员屡次提及“航行自由计划”,中国外交部发言人陆慷在当日的例行记者会上驳斥称,美方混淆商业航行自由和军舰横行自由的概念,《联合国海洋法公约》未明确赋予军舰无害通行权,美方应尊重基本事实。

  有记者问,美国务院官员拉塞尔10日称,航行自由行动对小国很重要。如果世界最强大的海军都无法在国际法允许的海域航行,小国军舰将会怎样?如美军舰都无法行使国际法赋予的权利,渔船和货轮又怎能避免被大国阻拦?中方对此有何评论?

  “美国官员开始重视国际法了,这很好。而且,我们希望美方尽快批准并加入《联合国海洋法公约》,这样就会使自己再谈国际法时听起来比较有说服力。”陆慷回应称。

  陆慷表示,美方官员说“航行自由对小国很重要”,但似乎又忘了区分商业航行自由和军舰的横行自由了。小国同大国一样,当然都希望确保符合国际法的商业航行自由,而这个自由在南海地区到目前为止从没问题。但没有哪个国家会像美方一样主张违反国际法的军舰的横行自由。

  他指出,《联合国海洋法公约》规定,外国船舶可以无害通过他国领海,但未明确赋予军舰这一权利。美国拒不批准公约,却抢在公约签订前推出了所谓的航行自由计划,从一开始就遭到了许多国家、特别是中小国家的反对。希望美方官员在谈小国感受时,首先尊重这一基本事实。

  “我还希望,下次美方官员再谈航行自由时,记者朋友们先请他/她澄清一下指的到底是商业航行还是军事航行。”他说。
