2015年8月26日，陈某某用其微信号在线下联系被害人赵某某，将自己在《大话西游2》中所有的六只“神兽”和三件“装备”作价17500元，在线下以4次微信转账的方式卖给了被害人赵某某。2015年8月28日，陈某某又向该游戏客服谎称游戏ID被骗，通过游戏商客服将出售给赵某某的六件“神兽”和三件“装备”追回，被害人赵某某发现被骗后报案。公安、检察机关认为被告人陈某某诈骗他人财物数额较大，已触犯刑律，依法对被告人陈某某采取强制措施，后被告人陈某某被移交法院追究刑事责任。

法院经审理认为，被告人陈某某利用其熟知线下交易规则的优势，明知线下交易不受游戏商的保护，追回卖出的装备较容易，却以非法占有为目的，使用欺骗游戏客服的方法，将线下已卖出的游戏装备追回，骗取了被害人即装备实际所有人数额较大的财物，侵犯了被害人的财产权利。本案中，虽然受骗者和财产损失者不是同一人，但是受骗者与财产处分人是同一人，即游戏客服，成立三角诈骗关系，其行为仍然构成诈骗罪，应予惩处。由于被告人系初犯、偶犯，积极认罪退赔，并获得了被害人谅解，应当从轻处罚。法院遂依法作出上述判决。宣判后，被告人陈某某表示不上诉。
