Millet argues that defendant is to take millet company ride, so that the public mistakenly believed that the electric car is millet production or associated with millet company, so the lawsuit asked the Court to order the other party to pay 500,000 yuan.
Haidian District Court concluded that the defendant's use in the production of electric vehicles and millet trademarks of similarity and millet Lei, the founder of the same name as a trademark, highlighting the subjective malice millet company trademark violations.

小米公司诉称，小米公司2012年在第12类电动运载工具上申请注册了“m”商标，并将该商标用于九号迷你平衡车上。雷军作为小米公司的创始人和法定代表人，在2015年1月出具声明，授权小米公司可使用其名字进行商业活动。后来，小米公司发现被告生产的“雷军电动车”使用了小米的标识作商标。小米公司认为，被告这是为了搭小米公司的便车，使公众误认为该款电动车是小米公司生产的，或者与小米公司有关联，故诉请法院判令对方赔50万元。
海淀法院审理后认为，被告在生产的电动车上使用的商标与小米商标高度相似，还将与小米创始人雷军相同的名称作为商标，凸显主观恶意侵犯小米公司商标专用权。
最终，海淀法院做出上述判决。
