法制日报报道称，北京一中院经审理认为，被异议商标的申请日期为2007年9月29日，而苹果公司针对其“IPHONE”商标提交使用证据绝大多数形成于被异议商标申请日之后，且数量很少，故苹果公司提交的证据不足以证明其“IPHONE”商标于被异议商标申请前达到驰名程度。被异议商标的申请注册未违反2001年商标法的有关规定。故驳回苹果公司的诉讼请求。苹果公司不服一审判决，向北京市高级人民法院提起上诉。
