　　娄底中院的判决书认定，罗仁初及其妻彭细秀都在爱心养老院当护工，至2015年2月18日，爱心养老院拖欠两人约4万元工资。其间，罗仁初多次找房鸿春讨要未果，房鸿春承诺在2015年春节前支付1万元。2015年2月18日（大年三十），房鸿春支付了4000元，罗仁初不同意，强烈要求再支付6000元，房鸿春向其弟借2000元给了彭细秀，罗仁初仍不满。

　　罗仁初的辩护律师曹远泽曾在一审时当庭申请对罗仁初进行精神病鉴定，法院审查认为，有证人证明罗仁初精神正常，且辩护人没有提供罗仁初精神不正常的证据或线索，因此未予采纳。被告人罗仁初认为事出有因，应当从轻处罚，当庭提出上诉。
