益阳市原书记马勇案：收金条干预命案让凶手获轻判

　　3月29日上午，湖南省郴州市中级人民法院开庭审理湖南省委原副秘书长、益阳市委原书记马勇涉嫌滥用职权罪、受贿罪一案。

　　出庭时，1957年出生的马勇已是头发全白。庭审中，对于检方指控的涉嫌滥用职权、受贿等犯罪事实，马勇当庭表示没有异议。

　　马勇落马之后，其干预司法的案例因其影响恶劣曾多次被通报。2016年2月1日，中央政法委公开通报7起领导干部干预司法典型案例，第一起即为马勇干预的“胡氏兄弟故意伤害案”。

　　该通报称，2012年11月3日晚，浙江籍男子胡氏兄弟2人与袁某发生争执，对袁某进行殴打，其中1人持水果刀将袁某捅死。2013年8月1日，益阳市赫山区法院以故意伤害罪分别判处胡氏兄弟有期徒刑五年；有期徒刑三年，缓刑三年。后经查明，在该案办理过程中，马勇收受胡氏兄弟亲属贿赂，借口“保护外来投资者合法权益”，违法干预司法活动、插手具体案件处理；益阳市多名政法干警和案件辩护律师违法帮助被告人减轻罪责，导致该案重罪轻判。

　　澎湃新闻曾调查采访多个交叉信源，证实在马勇“过问”该命案之后，看守所民警为被告人制造假立功，法院审委会改变合议庭意见作出轻判，检察官疑在此案中存在渎职行为。

　　今年“两会”上，最高人民检察院检察长曹建明在做工作报告时也专门提到该案，检察机关对涉嫌职务犯罪的9名司法人员依法追究刑事责任。

　　马勇案的起诉书显示，2012年至2013年间，时任益阳市委书记的马勇应胡双福（另案处理）的请求，向益阳市政法委、益阳市公安局相关领导就胡勋涛、胡勋恒故意伤害一案打招呼，后在其办公室收受胡双福托人转送的人民币10万元及价值3.3万元人民币的100克“百福图”金条一根。

　　在29日的法庭上，马勇对该项指控未提出异议，但他当庭表示，对这起“胡氏兄弟故意伤害案”并不了解，“事情发生在2012年底，我是2013年3月离开益阳调省委，此后，我再未过问，也没有任何人向我介绍过情况，不知道这个是什么案子，判了什么罪都不清楚。”

　　在马勇干预司法案发后，“胡氏兄弟故意伤害案”也已进入法院再审纠错程序。3月25日，郴州市中级人民法院已在法院门前张贴公告称，该院将于3月30日开庭审理“胡勋涛、胡勋恒故意杀人罪”一案，显见该起命案指控的罪名已由故意伤害罪变成了故意杀人罪。
