#法晚深度即时#（稿件统筹 朱顺忠 记者 王硕 实习生 张喜斌） 今日下午，法晚记者（法晚微信ID：fzwb_52165216）通过河南省人民检察院获悉，吴留锁故意杀人罪一案的申诉，其检察院于2016年2月25日受理。现因河南省高级人民法院对原判决、裁定调卷审查，根据《人民检察院复查刑事申诉案件规定》第六十条第一款第一项规定，其检察院决定中止审查，待中止的原因消除后，立即恢复审查。
据法晚记者（法晚微信ID：fzwb_52165216）了解，吴留锁是河南省洛阳市伊川县城关镇邑涧村一农民。1984年7月29日，邑涧村的一名8岁男童被人杀害。两个月后，吴留锁被认定为凶手遭遇刑事拘留。1984年12月8日，吴留锁被洛阳地区中级人民法院以故意杀人罪判处死刑。1985年4月13日，河南省高级人民法院以“事实不清，证据不足”为由将案件发回重审。1986年，洛阳市人民检察院再度将吴留锁案公诉至洛阳市中级人民法院。因为没有新的证据，案件被退回补充侦查。此后，由于一直没有新的证据，吴留锁一直被羁押在看守所里。1998年11月12日，吴留锁已经被羁押了14年多的时间。1998年12月15日 吴留锁被洛阳市中级人民法院判处死刑缓期两年执行。2015年5月，河南省高级人民法院直接核准了洛阳市中级人民法院的死刑缓期两年执行的判决。
今日下午，法晚记者（法晚微信ID：fzwb_52165216）通过河南省人民检察院于2016年3月15日发布的《刑事申诉中止审查通知书》获悉，吴留成（吴留锁的弟弟）不服河南省高级人民法院以故意杀人罪核准的（1999）豫刑一复字第37号刑事裁定书，向其检察院提出申诉，并于2016年2月25日受理。现因河南省高级人民法院对原判决、裁定调卷审查，根据《人民检察院复查刑事申诉案件规定》第六十条第一款第一项规定，其检察院决定中止审查，待中止的原因消除后，立即恢复审查。
