　　社科院常纪文：实行10至20年廉洁官员将逐步淘汰腐败官员

　　法制晚报讯 (记者汪红) 反腐要采用新人新办法、老人老办法的机制，对于新提拔的干部和新进入体制内的人要公开财产、资格和经历。

　　中国社科院法学所研究员常纪文近日撰文称，基于我国国情，短期内实现全面财产公开可能有困难，即使强行实施，也可能出现弄虚作假难以被全部发现的情况。因此，可以实行新人新办法，对于新提拔的干部和新进入体制内的人逐年实现公开财产，接受社会监督；而对于未能得到提拔的干部，则通过现行的办法和制度进行反腐。

　　如此，就可以保障新人、新干部的廉洁性，逐步提高体制内廉洁力量的比例，遏制和缩小既有腐败力量的比例。对于那些害怕暴露不想被提拔的腐败分子，或者由于能力和资历不足不能被提拔的人，可以使他们难以得到更高的岗位进一步腐败。

　　这种制度若实行10至20年，新的廉洁的人不断充实干部队伍和各级领导岗位，形成廉洁的气候，必然挤压和监督旧的腐败力量，就可以逐步把未暴露的腐败分子淘汰出权力队伍。

　　另外，在选拔用人上，应从内部繁殖向公开选拔、公开遴选、竞争上岗等减少发生腐败机会的方式转变，尤其是高层干部的公开选拔，是从“根”上减少腐败的有效方式。基层干部的选拔不必在全省甚至全国范围公开，这样会浪费行政资源。处级干部可以在本省范围公选；科级及以下干部可以在本市、县范围公选。公开选拔可以使庸官、懒官、贪官无晋升的机会。

　　新修订的刑法减少了适用死刑的情形。特别是最近几年的司法审判实践表明，对特大贪污受贿判处死刑的情形极少。常纪文认为，在刑事处罚中过分强调贪污腐败分子的生命权保护不妥当。
