　　新华网广州3月20日电(记者毛一竹)记者20日从广州市中级人民法院了解到，该院对广州市白云区明星村党支部书记梁锡全、东华村村委会主任周本财等28人涉嫌受贿的案件进行一审宣判。法院以非国家工作人员受贿罪，分别判处梁锡全、周本财有期徒刑八年、有期徒刑七年，其他26名村官也因构成非国家工作人员受贿罪，分别被判处三年至6个月不等有期徒刑并适用缓刑。

　　法院审理查明，2005年，广州市国土资源和房屋管理局将广州市白云区人和镇以西、广花公路以南、方华路北侧窝西地段供白云区人和镇政府作复建安置用地，属国有建设工业用地。2010年10月，白云区人民政府确定，将其中70亩土地按统一规划、统一建设的原则，由白云机场第三跑道主体工程用地的人和镇东华村、汉塘村、明星村、高增村，按一定比例按建筑和土地成本分配建筑面积或收益。

　　2012年初，广东申通公司董事长高汤根(另案处理)打算开发前述70亩土地，因该地块已按比例分由高增村、东华村、汉塘村、明星村经营管理，高汤根遂与四个村的负责人戴敏智、周本财、李瑞陶、梁锡全洽谈，分别负责确保本村同意出租，事后另行付给其四人好处费各400万元。

　　租赁合同签订后，高汤根按照约定，向4人分别支付了400万元“好处费”。梁锡全和周本财收款后，自己拿了大头，剩下的按不同比例分给了多名村官。戴敏智则独吞了400万元。

　　法院审理认为，根据法律规定，村两委会及村民小组等村委会下设的组织是村民自治组织，村基层组织成员不是国家工作人员；涉案土地属国有划拨工业用地。涉案人员利用职务上的便利，非法收受他人财物，为他人谋取利益，数额巨大，其行为均构成非国家工作人员受贿罪。

　　法院分别以非国家工作人员受贿罪判处梁锡全有期徒刑8年、判处周本财有期徒刑7年。除贿款被全部追缴上缴国库外，两人还被并处没收个人财产10万元。其他20多名村官也因构成非国家工作人员受贿罪，分别被判处3年至6个月不等有期徒刑并适用缓刑。

　　另外，高增村村委会主任戴敏智此前已被广州市中院以同一罪名判处有期徒刑9年，并处没收个人财产10万元。
