2011年最高人民法院、最高人民检察院出台的《办理侵犯知识产权刑事案件的指导意见》中明确了通过信息网络传播他人作品的行为属于刑法意义上的发行行为。

通过建立“盗版”视频网站，以营利为目的，未经著作权人许可，播放他人享有信息网络传播权作品的行为属于侵犯著作权人著作权的行为，故达到刑事案件的追诉标准就应依法追究刑事责任。
