　　本报杭州1月29日电（记者江南）今后，对于犯罪时不满十八周岁、被判处五年有期徒刑以下刑罚以及免于刑事处罚的未成年被告人，浙江的法院、检察院、公安、司法行政机关将对其犯罪记录作技术封存。日前，该省12个部门联合出台《浙江省未成年人犯罪记录封存实施办法（试行）》，保障被封存犯罪记录的未成年人在入学、复学、升学及其他基本生活保障方面享受“同等待遇”，有关法律文书将不再归入学生档案、人事劳动档案。

　　犯罪记录包括立案文书、侦查文书、检察文书、审判文书、刑罚执行文书等法律文书，以及其他从立案侦查到刑罚执行完毕整个刑事诉讼活动中形成的相关案件材料。未成年人犯罪记录封存后，一般只有相应的司法机关才能看到。裁判文书一般也都不送达未成年被告人所在的学校、居委会、村委会等。为了免除未成年人及其家属的后顾之忧，浙江省明确规定，教育部门不能把犯罪记录放进学生档案，劳动部门不能把犯罪记录归入人事劳动档案。

　　去年以来，浙江检察机关全面推行未成年人刑事案件专门机构或专人办理，并先行开展未成年人犯罪记录封存的探索实践，全年对1313人次未成年人依法作出不批捕、不起诉决定。
