　　本报合肥12月29日电 （记者钱伟）近日，安徽泾县一位老人去世后，家属执意将老人土葬并拒绝整改，泾县民政局等部门于12月19日将已下葬的老人强制挖坟火化，致其家属不满。对此，安徽省民政厅相关负责人表示，泾县强制执行的做法不妥，违反了国家《殡葬管理条例》，目前已对此事展开调查。

　　泾县民政局相关负责人表示，泾县属于火葬区，遗体一律火化，逝者家属违规土葬，所以泾县民政部门才将其强制火化。对此，安徽省民政厅相关人士表示，2012年国务院已将《殡葬管理条例》第二十条修改为：“将应当火化的遗体土葬，或者在公墓和农村的公益性墓地以外的其他地方埋葬遗体、建造坟墓的，由民政部门责令限期改正。”此前该条款中“对于拒不改正的，可以强制执行”条文已被删除。地方应按照国务院规定执行，强制执行缺乏法律依据。
