　　中新社北京12月28日电 (记者 蒋涛) 记者28日从全国人大法律委员会的有关报告中获悉，刑法修正案已经列入十二届全国人大常委会立法规划和2014年立法工作计划。

　　十二届全国人大第一次会议期间，部分全国人大代表在议案中提出，建议修改完善刑法有关条款，主要包括增加规定吸毒驾驶犯罪，职业发放高利贷罪，虐待儿童罪，破坏村民委员会选举罪等；完善强奸罪，收买被拐卖的妇女儿童罪，嫖宿幼女罪，拒不执行判决、裁定罪，非法行医罪，非法进行节育手术罪，受贿罪的有关规定；对醉酒驾车犯罪进行立法解释，刑法应平等保护民营企业等问题。

　　十二届全国人大常委会第六次会议28日表决通过了全国人大法律委员会关于十二届全国人大第一次会议主席团交付审议的代表提出的议案审议结果的报告。全国人大法律委员会在审议意见中表示，对于议案中提出的修改完善刑法的有关内容，法制工作委员会已经着手调研论证，将根据十八届三中全会精神，听取有关方面意见，在刑法修改工作中统筹考虑。其中，有些内容，法制工作委员会将适时提出修改刑法的建议或者法律解释的建议。

　　记者还从这份报告中了解到，针对一些代表提出的关于修改公益事业捐赠法的议案，全国人大法律委员会认为，公益事业捐赠法与慈善事业法有着紧密联系，议案中所提的建议，多属于慈善事业法调整和规范的内容。制定慈善事业法已经列入十二届全国人大常委会立法规划，确定由全国人大内务司法委员会负责起草。法律委员会、法制工作委员会将与内务司法委员会密切沟通，将公益事业捐赠法的修改与慈善事业法的制定一并统筹研究。(完)
