　　信息时报讯 (记者 魏徽徽) 原新广国际集团董事长吴日晶涉嫌受贿、挪用公款、行贿于2011年10月在中山市中院受审，当庭痛陈悔意求法院轻判“不要让我死在监狱里”。吴日晶最终获刑几许成迷， 日前，吴日晶家属对广州市中院受委托查封的一套越秀区房改房提出执行异议，使该案进展再次受到关注。据悉，吴日晶最终获判无期徒刑，没收个人全部财产。广州市中院于本月初驳回了执行异议。

　　记者获悉，原新广国际集团董事长、总经理吴日晶涉嫌受贿2790万元，挪用公款人民币1.445亿元及美元1200万元，以及行贿108万元，中山市中级人民法院一审对其判处无期徒刑，并处没收个人全部财产。

　　广州中院相关执行裁决书透露，法院查封了吴日晶名下位于广州市东山区(现越秀区)永胜东街的一套房改房，其后，吴日晶的家属对该查封行为提出了执行异议。

　　吴日晶家属称，被查封房屋为吴日晶夫妇的唯一住房，如果该房屋被强制拍卖处理，将使其家庭居无定所，不利于吴日晶的改造。据悉，吴日晶被省纪委双规后，按照省纪委的要求，共退还财产人民币1078万元，港币10万元。

　　广州中院驳回异议

　　广州市中院认为，中山市中院以被执行人吴日晶在广州没有财产，而在其辖区内有可供执行财产为由，将该案委托执行符合法律规定。

　　而根据《最高人民法院关于人民法院民事执行中查封、扣押、冻结财产的规定》，“对被执行人与其他人共有的财产，人民法院可以查封、扣押、冻结，并及时通知共有人。共有人协议分割共有财产，并经债权人认可的，人民法院可以认定有效。查封、扣押、冻结的效力及于协议分割后被执行人享有份额内的财产；对其他共有人享有份额内的财产的查封、扣押、冻结，人民法院应当裁定予以解除。共有人提起析产诉讼或者申请执行人代位提起析产诉讼的，人民法院应当准许。诉讼期间中止对该财产的执行。”

　　广州市中院认为，依照上述规定，法院可以对吴日晶与其妻子共有的财产进行查封。因目前涉案房屋尚未析产，吴日晶家属可另循法律途径解决后再对确定属于其所有的部分申请解除查封。另外，因本院的查封措施只是财产的控制措施，并未实际处分，不影响其家属及扶养人的居住权。据此，广州市中院裁定驳回异议。
