Draft amendment adds: the Supreme People's Procuratorate, people's courts at various levels have been legally effective judgments or orders, people's procuratorates at higher to lower people's courts have been legally effective judgments or orders, found a retrial statutory, should be challenged.

　　新华网北京12月23日电（记者杨维汉、史竞男）23日提请十二届全国人大常委会第六次会议审议的行政诉讼法修正案草案拟增加规定，加强人民检察院对行政诉讼的监督，人民检察院监督行政审判可提检察建议或抗诉。

　　现行行政诉讼法规定，人民检察院有权对行政诉讼实行法律监督。对已经发生法律效力的判决、裁定，发现违反法律、法规规定的，有权提出抗诉。

　　据了解，已经修改的民事诉讼法中细化了检察机关对民事诉讼的监督，因此行政诉讼法修改也参照民事诉讼法，进一步细化审判监督条款，加强人民检察院对行政诉讼的监督。

　　修正案草案增加规定：最高人民检察院对各级人民法院已经发生法律效力的判决、裁定，上级人民检察院对下级人民法院已经发生法律效力的判决、裁定，发现存在再审法定情形的，应当提出抗诉。

　　草案明确，地方各级人民检察院对同级人民法院已经发生法律效力的判决、裁定，发现存在再审法定情形的，可以向同级人民法院提出检察建议，并报上级人民检察院备案；也可以提请上级人民检察院向同级人民法院提出抗诉。

　　此外，草案还增加规定，地方各级人民检察院对审判监督程序以外的其他审判程序中审判人员的违法行为，有权向同级人民法院提出检察建议。
