　　南都讯 今年59岁的汕尾海丰人黄志光，从一名普通的运输工人做起，历任深圳市宝安区委书记、汕头市委书记、深圳市政协副主席，官至正厅级。2011年2月黄志光落马，被指控涉嫌受贿人民币及财物共550余万元，并非法持有猎枪等7支制式枪支。广州市中院昨日对该案一审宣判，最终认定其受贿金额为300余万元，并以受贿罪、非法持有枪支罪两罪并罚，判处其有期徒刑14年，没收财产50万元。

多次助下属升迁收虫草现金贿赂

　　广州市中院经审理查明，黄志光在1998年至2003年担任深圳市宝安区委书记期间，利用职务便利先后多次收受该区农业局局长、宝安区光明街道办事处主任、党委书记刘某某给予的现金人民币35万元，为刘的职务升迁提供帮助。

　　另外在2001年至2002年间，身为宝安区委书记的黄志光，还先后两次收受宝安区教育局副局长郑某某给予的现金人民币40万元、港币2万元，为郑的职务升迁提供帮助。

　　黄志光被认定的第3单指控，是在2002年至2010年间，他从宝安区委书记调任至汕头市长、汕头市委书记，其间，他多次收受深圳市友和集团公司董事长詹某某给予的玉石摆件26件(价值人民币169.45万元)，香枝木罗汉床1张(价值人民币27万元)，维腊木插画桶1个(经鉴定价值人民币4000元)，为詹的亲戚黄树光职务调动、詹在汕头市南澳县投资以及其投资的香港潮声卫视在汕头市设立记者站等事项提供帮助。

　　法院同时还认定，2008年至2010年，黄志光在担任汕头市委书记期间，先后两次收受汕头市委副秘书长吴某某给予的冬虫夏草17斤，为吴的职务升迁提供帮助。

　　两罪并罚判刑14年没收财产50万元

　　对于检方指控黄志光涉嫌从1985年至2002年期间，先后非法持有制式猎枪、气枪共7支的事实，广州市中院予以了认定。

　　广州市中院认为，黄志光上述行为分别构成受贿罪、非法持有枪支罪，检方指控的犯罪事实基本清楚，证据确凿，唯指控的受贿数额有误，予以纠正。黄志光一人犯数罪，应数罪并罚，根据其部分退赃、悔罪等情节，对其判处有期徒刑14年的刑罚，并处没收财产人民币50万元。

　　两项指控为何不认定受贿？

　　据此前检方指控，黄志光的结拜义兄———汕尾商人黄顺丰，与黄志光案存在诸多金钱瓜葛。黄顺丰涉嫌利用前者的政界身份，获取工程牟利；或者利用与前者的私密关系，接受别人请托助人职务调动升迁。因此在2007年黄志光要购买一栋别墅时，黄顺丰主动为其垫付了120万元的购房款但黄志光未归还，涉嫌变相受贿。

　　不过此项指控最终未被法院认定。广州市中院审理后认为，黄志光、黄顺丰两人在侦查阶段的有罪供述不能吻合印证，庭审期间均翻供该笔款项属借款并已归还，而其他证人证言也出现反复，法官认为该部分指控证据不足，不予支持。

　　检方另外一项被推翻的指控，是2008年前后黄志光接受商人李亚鹤100万元捐给老家的鸡鸣寺作为修建大佛资金一事。

　　法院认为，李亚鹤委托黄志光之子将一箱土特产捎带回家，放置几日后带往鸡鸣寺开封，才知是100万元现金。法官称，李亚鹤付出该100万元给黄志光同意以其名义捐出的目的均是为了捐资建佛，款项实际也系寺庙收取，黄本人没有非法占有该笔款项的主观故意。客观上100万元密封放置于黄志光家中数日其不知情也未占有，捐出后寺庙也未返还任何款项，捐赠登记也是以其儿子名义进行，并未获得法律意义上的利益，鉴于黄志光上述行为与其他收受他人贿赂后再向寺庙捐款的行为存在上述主观、客观的区别，法院对该部分指控不予支持。

　　至此，检方指控的550余万元的受贿指控中，广州市中院予以认定了其中的300余万元现金及财物，构成受贿。
